1. Agreement
By downloading or using MaQkrs AI Tutor ("the app") you agree to these Terms and to Apple's Standard Licensed Application End User License Agreement ("Apple EULA"). If the two conflict, the Apple EULA governs your licence to the app itself. If you don't agree, don't use the app.
2. Who may use the app
You must be 18 or older to use MaQkrs AI Tutor.
What the app is
MaQkrs AI Tutor is a study tool. You add your own material, ask questions, and get AI-generated answers produced on your device. The app is under active development. Beta versions are pre-release software: features may be missing, switched off, or changed, and they may not work as described.
3. AI-generated content: please check it
- Answers are generated automatically by AI models (Apple's on-device model or an optional Google Gemma model). They can be wrong, incomplete, or out of date, even when the app shows a source passage.
- Always check answers against your sources and your instructor's guidance. The app is not a substitute for professional, medical, legal, financial or other expert advice, and is not authoritative academic advice.
- Follow your school's or institution's rules on AI use. You are responsible for how you use what the app produces.
4. Your material
- You keep all rights to the material you add. It stays on your device (see the Privacy Policy).
- Add only material you own or have permission to use. Don't add other people's private information (for example, student records) unless you are authorised to.
5. Acceptable use
You agree not to use the app, or any AI model used through it, to: 1. break any law, or infringe anyone's intellectual property, privacy or other rights; 2. create, promote or facilitate content that exploits or harms children, including child sexual abuse material; 3. promote or facilitate violence, terrorism, violent extremism, hatred, harassment, bullying, or self-harm; 4. facilitate illegal activities, weapons misuse, or the sale or making of illegal goods or substances; 5. create spam, scams, phishing, malware, or other fraudulent or deceptive content, including impersonating a person or passing off AI-generated content as human-made in order to deceive; 6. create sexually explicit content (scientific, educational, documentary or artistic content is not covered by this restriction); 7. practise any profession without a licence, or make automated decisions with a material effect on people's rights or wellbeing (for example in employment, health, legal, finance, housing, insurance or social welfare); 8. collect, infer or generate sensitive personal information about people without the required consent, or track or monitor people without their consent; 9. get around safety features or deliberately push a model to break these rules; 10. try to extract or reproduce the training data of Apple's AI models, remove content credentials or watermarks, or show Apple or its products in a false or derogatory light.
These rules include the restrictions in Google's Gemma Prohibited Use Policy (https://ai.google.dev/gemma/prohibited_use_policy) and Apple's Acceptable use requirements for the Foundation Models framework (https://developer.apple.com/apple-intelligence/acceptable-use-requirements-for-the-foundation-models-framework/), and you agree to follow both. If those policies are updated, the updated versions apply.
6. AI models and third-party software
- Google Gemma 4 models are optional downloads that come directly from Hugging Face. They are provided by Google under the Apache License 2.0 (https://ai.google.dev/gemma/docs/gemma_4_license) and converted to the MLX format by the mlx-community project. Your use of the model files is also subject to that licence. Gemma is a trademark of Google LLC; we are not affiliated with or endorsed by Google.
- Apple's on-device model and Apple Private Cloud Compute are provided by Apple under Apple's terms.
- The app includes open-source software. Licences and notices are available in the app under Profile and Settings > About & Licences (Third-Party Notices and Model Notices).
7. Subscriptions
- Freedom is free and lets you create two workspaces. MaQkrs Pro is an optional auto-renewable subscription, offered monthly or yearly, that unlocks additional workspaces and Pro features. The current price and billing period are shown in the app and on the App Store purchase sheet before you confirm.
- Billing is handled by Apple. Payment is charged to your Apple Account when you confirm the purchase. We never see your payment details.
- Auto-renewal: your subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within the 24 hours before the current period ends.
- Cancelling: manage or cancel in your Apple Account subscription settings (in the app: Profile and Settings > Subscription > Manage Subscriptions). Cancelling stops future renewals. Pro stays active until the end of the period you've paid for.
- Refunds are handled by Apple under Apple's policies. Request one at https://reportaproblem.apple.com.
- Restore Purchases: if you reinstall the app or use another device with the same Apple Account, tap Restore Purchases in Profile and Settings to restore an active subscription.
- If Pro ends, your existing workspaces and data remain available to view and delete. Creating more than the Freedom limit requires Pro again.
- Prices may change. Apple will notify you of price changes as its rules require.
- TestFlight betas: purchases made in a TestFlight build use Apple's sandbox test environment. They are free and you are not charged. Test subscriptions renew on an accelerated schedule (about daily, up to 6 times) and then stop. Test purchases don't carry over to the App Store version.
8. Beta testing
If you join a TestFlight beta: the build is confidential pre-release software, it may be unstable, and it expires. Keep backups of your original files. A beta is not a backup tool. Feedback you send may be used to improve the app.
9. No warranty
To the fullest extent the law allows, the app and its AI output are provided "as is" and "as available", without warranties of any kind, including accuracy, fitness for a particular purpose, and non-infringement. This doesn't affect consumer rights that cannot be excluded by law.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data, grades, or profits, arising from your use of the app or its AI output. Where liability cannot be excluded, our total liability is limited to the greater of (a) the amount you paid us for the app or subscription in the 12 months before the claim, or (b) US$50. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Changes and termination
We may update these Terms. The effective date above will change, and significant changes will be noted in the app or release notes. You can stop using the app at any time by deleting it. We may stop offering the app or a feature.
12. Governing law
These Terms are governed by the laws of the State of Alabama, USA, without regard to its conflict-of-law rules, except where the consumer protection laws of the place you live give you rights that cannot be waived.
